KATHMANDU
The Supreme Court has issued a show cause notice against decision of Attorney General to not take ahead the case against Chairman of Rastriya Swatantra Party (RSP), Rabi Lamichhane.
A single bench of Justice Hari Phunyal sought a written response from the Office of the Attorney General on why it decided to not forward case against Lamichhane. The show cause order came in response to a writ petition filed by advocate Yubaraj Poudel ‘Safal’. In the petition filed on Monday, advocate Poudel had demanded to scrap Attorney General Dr Dinmani Pokhrel’s decision to stop the case against misuse of passport by RSP Chairman Lamichhane.
He further said Attorney General Pokhrel’s decision condoned Lamichhane while the latter had to be punished. Earlier, SC had issued a verdict that Lamichhane had committed a procedural mistake in receiving Nepali citizenship, thereby depriving him of the citizenship. It led him to losing the membership to the House of Representatives and ministerial position as well.
Later, he acquired Nepali citizenship from Kathmandu District Administration Office by following a due process. Attorney General Dr Pokhrel had decided to not forward the case against RSP Chairman on misuse of passport on March 20.
